SCOPE OF APPLICATION

The following terms and conditions apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or self-employed professional activity. An entrepreneur is a natural or legal person, or a partnership with legal capacity, who acts in the exercise of their commercial or independent professional activity when entering into a legal transaction.

CONTRACTING PARTY, CONCLUSION OF CONTRACT, AND CORRECTION OPTIONS

The purchase agreement is concluded with SWISSFORCE PHARMA AG.

By displaying products in the online shop, we make a binding offer to conclude a contract regarding these items. You may initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting your order, you will receive a confirmation by email.

CONTRACT LANGUAGE AND STORAGE OF CONTRACT TEXT

The following languages are available for concluding the contract: German, English.

We store the contract text and send you the order details and these General Terms and Conditions in text form. For security reasons, the contract text is no longer accessible via the internet after the order process has been completed.

DELIVERY CONDITIONS

Shipping costs may be charged in addition to the stated product prices. Further details regarding shipping costs can be found in the respective offers.

We deliver by shipping only. Unfortunately, self-collection of goods is not possible.

We do not deliver to parcel lockers or Packstations.

PAYMENT

The following payment methods are generally available in our shop:

Credit Card

During the ordering process, you provide your credit card details. Your card will be charged immediately after the order is placed.

PayPal, PayPal Express

To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself using your login credentials, and confirm the payment instruction. The payment transaction is processed by PayPal immediately after the order is placed. Further information will be provided during the ordering process.

Google Pay

To pay the invoice amount via the payment service provider Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have the Google Pay function activated, authenticate yourself using your login credentials, and confirm the payment instruction. The payment transaction is processed immediately after the order is placed. Further information will be provided during the ordering process.

Apple Pay

To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have the Apple Pay function activated, authenticate yourself using your login credentials, and confirm the payment instruction. The payment transaction is processed immediately after the order is placed. Further information will be provided during the ordering process.

WARRANTY AND GUARANTEES

The statutory warranty provisions shall apply.

6.2 Additional Guarantees and Customer Service

Information regarding any additional guarantees that may apply and their specific conditions can be found with the respective product and on dedicated information pages in the online shop.

LIABILITY

We shall always be liable without limitation for claims arising from damages caused by us, our legal representatives, or agents:

  • in the event of injury to life, body, or health;
  • in the event of intentional or grossly negligent breach of duty;
  • in the case of guarantee commitments, where agreed; or
  • where liability under the Product Liability Act applies.

In the event of a slightly negligent breach of essential contractual obligations, the fulfillment of which is necessary for the proper performance of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations), by us, our legal representatives, or agents, liability shall be limited to the foreseeable damage typical for the contract at the time the contract was concluded. In all other cases, claims for damages are excluded.

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
